The Privacy Policy is intended to describe the management of personal data collected by Scuderia Ferrari Club S.c.ar.l. (“Company”) through this website, in accordance with Regulation (EU) 2016/679 (“GDPR”).

COLLECTION OF PERSONAL DATA

The personal data that may be collected are as follows:

  • i. Personal data provided to receive a specific service (e.g., email address for newsletter subscription);
  • ii. Browsing data (e.g., IP address, location – country -, information on the pages visited by the user within the website, access time on the website, browsing time on each page, clickstream analysis. Although the Company does not collect this information to associate it with specific users, it is possible to identify such users directly through this information or by using other information collected);
  • iii. Cookies (i.e., small text files that can be sent and recorded on the user’s computer by the websites visited, to be then retransmitted to the same sites when the user visits them again. For further details, please refer to the Cookie Policy accessible at the following link).

PURPOSES AND METHODS OF PROCESSING

The personal data collected (“Data”) may be processed for the following purposes:

  • a) To execute a specific user request (e.g., request for membership to Scuderia Ferrari Club) or to provide the requested service (“Service”);
  • b) To allow the Company to conduct surveys aimed at improving the quality of the products and services provided, by virtue of the Company’s legitimate interest (“Customer Satisfaction”);
  • c) With the user’s consent, to send commercial and/or promotional communications about the Company’s products and services, as well as to conduct market research (“Marketing”);
  • d) With the user’s consent, to analyze behaviors, habits, and consumption propensities, in order to improve the products and services provided by the Company, as well as to meet the specific needs of customers (“Profiling”);
  • e) With the user’s consent, to allow Ferrari to communicate the Data to companies directly and indirectly controlled by Ferrari N.V. and/or affiliated with Ferrari S.p.A. (“Ferrari Group Companies”), which may process the user’s data to send commercial and/or promotional communications about the products and services of the aforementioned companies, as well as to conduct market research (“Ferrari Group Marketing”);
  • f) To improve the user’s experience on the Company’s websites.
  • g) At the user’s request, to allow the Company to send informational/editorial newsletters regarding updates on the Company’s activities and press releases.

The Data may be processed in paper, automated, or electronic form, and in particular by ordinary mail or email, telephone (e.g., automated calls, SMS, MMS), fax, and any other IT channel (e.g., websites, mobile apps).

Note: The Company does not intend to transfer the Data to third-party companies – except for the Ferrari Group Companies – so that these companies can process the Data for their own marketing purposes and/or other purposes.

OTHER PARTIES WHO MAY PROCESS THE DATA

The Data may be processed by entities operating on behalf of the Company and under specific contractual obligations, in EU or non-EU countries.
The Data may be communicated to third parties to comply with legal obligations, to comply with orders from public authorities, or to exercise a right of the Company in judicial proceedings.

TRANSFER OF DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)

In the context of the Company’s contractual relationships, the Data may be transferred outside the territory of the European Economic Area (EEA), including by entering them into databases managed by third-party companies operating on behalf of the Company. The management of the databases and the processing of the Data are bound to the purposes for which they were collected and take place in full compliance with the applicable data protection law.
Whenever the Data is transferred outside the EEA, the Company will take all appropriate and necessary contractual measures to ensure an adequate level of Data protection, including – among others – agreements based on the standard contractual clauses for the transfer of data outside the EEA, approved by the European Commission.

The Company declines any responsibility regarding requests and/or provision of personal data to third-party websites.

DATA RETENTION
The Data processed to provide the Service and for Customer Satisfaction will be retained by the Company for the period deemed strictly necessary to achieve these purposes.
Additionally, the Data processed to provide the Service may be retained for a longer period to manage any disputes related to the provision of the Service.
The Company will retain the Data collected for Marketing purposes for two years, while the Company will retain the Data collected for Profiling purposes for one year. If consent is withdrawn, even before the expiration of the relevant retention period indicated, the Data can no longer be processed for the aforementioned Marketing and Profiling purposes but may still be retained by the Company to manage any disputes and/or litigation.

The Data retention time for Marketing and Profiling purposes provided by the Company complies with local regulations as well as the provisions of the Data Protection Authority.

The Company will retain the personal data used to send newsletters until the user requests to unsubscribe from the newsletter service.

The Data processed to improve the user’s experience on the websites will be retained for the periods indicated in the Cookie Policy.

USER RIGHTS

The user is entitled to the following rights:

  • 1. Right of access, i.e., the right to obtain confirmation from the Company as to whether or not Data processing is ongoing and, if so, to obtain access to the Data;
  • 2. Right to rectification and erasure, i.e., the right to obtain the correction of inaccurate Data and/or the integration of incomplete Data or the deletion of Data for legitimate reasons;
  • 3. Right to restriction of processing, i.e., the right to request the suspension of processing if there are legitimate reasons;
  • 4. Right to data portability, i.e., the right to receive the Data in a structured, commonly used, and machine-readable format, as well as the right to transmit the Data to another data controller;
  • 5. Right to object, i.e., the right to object to the processing of the Data if there are legitimate reasons, including the processing of Data for marketing and profiling purposes, if applicable;
  • 6. Right to lodge a complaint with the competent data protection authority in case of unlawful Data processing.
